The website www.sportperformancecentres.org (the “Website”) is owned and operated by the Association of Sport Performance Centres (ASPC), formally constituted under the name “ASOCIACIÓN DE CENTROS DE RENDIMIENTO DEPORTIVO (ASPC)”, a non-profit legal entity registered in Spain and governed by Spanish law.

The Association has an international scope and carries out its activities worldwide. In accordance with its By-Laws, English is the working language for activities of an international nature.
For the purposes of applicable data protection legislation, the ASPC acts as the data controller in respect of the personal data processed through this Website and through the communications and services made available by the Association, unless otherwise expressly stated.
All intellectual property and industrial property rights relating to the Website, including, without limitation, its texts, documents, photographs, images, graphics, databases, audiovisual content, software, source code, logos, trademarks, trade names, domain names and other distinctive signs, are owned by or lawfully licensed to the ASPC and are protected under applicable Spanish and European legislation.
Unless expressly permitted by law or previously authorised in writing by the ASPC, the reproduction, distribution, public communication, making available to the public, transformation, adaptation or any other form of exploitation, whether in whole or in part, of the contents of the Website is prohibited.
Users are authorised to access and use the Website and its contents solely for lawful purposes and in accordance with this Legal Notice and the applicable legislation. Such access and use shall not be construed as the granting, transfer or assignment of any intellectual or industrial property rights.
In particular, the ASPC does not grant users any licence or right to use its trademarks, logos, trade names or other distinctive signs beyond what is strictly necessary for the normal use of the Website, unless expressly authorised in writing.
Any unauthorised use of the Website or its contents may give rise to the exercise of any civil, administrative or criminal actions available to the ASPC under applicable law.
The ASPC is committed to protecting the privacy and personal data of users of the Website and processes personal data in accordance with applicable data protection legislation, in particular:
- Regulation (EU) 2016/679 of 27 April 2016 (“General Data Protection Regulation” or “GDPR”);
- Spanish Organic Law 3/2018 of 5 December on the Protection of Personal Data and Guarantee of Digital Rights (“LOPDGDD”); and
- any other applicable Spanish or European legislation governing the processing and protection of personal data.
The ASPC implements appropriate technical and organisational measures designed to ensure the security, confidentiality and integrity of personal data and to prevent unauthorised access, alteration, loss or disclosure.
Depending on the services or forms used by the user, the Website may collect and process personal data such as:
- name and surname;
- professional or organisational details;
- email address;
- telephone number;
- postal address;
- information provided when registering for Association activities, events or forums;
- information provided through contact forms, membership applications, surveys or other communications; and
- technical information relating to the use of the Website, where such information constitutes personal data.
Users are responsible for ensuring that the personal data they provide to the ASPC is accurate, complete and up to date.
Personal data will be processed only for specified, explicit and legitimate purposes, including, where applicable, managing communications with users, responding to enquiries, administering membership or participation in ASPC activities, managing registrations and events, maintaining the Website, complying with legal obligations and sending communications relating to the Association where there is an appropriate legal basis to do so.
The legal basis for each processing activity may include the performance of a contract or pre-contractual measures, compliance with legal obligations, the legitimate interests of the ASPC, or the user’s consent, as applicable.
The ASPC will retain personal data only for as long as necessary to fulfil the purposes for which it was collected and, where applicable, for the periods required to comply with legal obligations or to establish, exercise or defend legal claims.
Users have the right, subject to the conditions established by applicable law, to:
- access their personal data;
- request the rectification of inaccurate or incomplete data;
- request the erasure of their personal data;
- request restriction of processing;
- object to the processing of their personal data;
- request data portability, where applicable; and
- withdraw consent at any time where processing is based on consent.

The request should identify the right being exercised and provide sufficient information to enable the ASPC to verify the identity of the requester.
The ASPC will respond to requests within the period established by applicable data protection legislation. Under the GDPR, the general response period is one month, subject to the circumstances and extensions permitted by law.
Users also have the right to lodge a complaint with the competent supervisory authority. In Spain, the competent supervisory authority is the Spanish Data Protection Agency (Agencia Española de Protección de Datos – AEPD).
The applicable data protection framework also requires controllers to adopt appropriate technical and organisational measures and, where applicable, appropriate arrangements with processors and other service providers.
The Website may use cookies and similar technologies to ensure its proper operation, remember user preferences, analyse Website usage and improve the user experience.

The ASPC endeavours to ensure that the information published on the Website is accurate, current and accessible. Nevertheless, the ASPC does not guarantee that the Website will be continuously available or free from errors, omissions or interruptions, particularly where these are caused by circumstances beyond its reasonable control.
To the extent permitted by applicable law, the ASPC shall not be liable for damage or loss arising from, among other circumstances:
- interruptions, failures, delays, errors or disconnections affecting telecommunications networks or electronic systems;
- technical failures or temporary unavailability of the Website;
- malicious software, cyberattacks or other security incidents caused by third parties, despite the adoption of reasonable security measures;
- improper, unlawful or unauthorised use of the Website;
- errors resulting from the use of outdated or incompatible browsers, devices or software;
- the accuracy, completeness or availability of information supplied by third parties;
- third-party websites, platforms or services accessible through links from the Website;
- content published by users or third parties on external websites or social media platforms; or
- decisions taken by users on the basis of information published on the Website.
The inclusion of links to third-party websites does not imply any endorsement, sponsorship, recommendation or assumption of responsibility by the ASPC for the content, services, privacy practices or security of those websites.
The ASPC reserves the right to modify, suspend or discontinue, temporarily or permanently, any part of the Website or its contents where necessary, including for technical, operational, security or organisational reasons.
Users shall be responsible for any damage or loss caused to the ASPC as a result of unlawful or improper use of the Website or of any attempt to interfere with its normal operation, including the use of automated systems, robots, spiders, crawlers or similar tools to access, extract or collect information in a manner that is contrary to applicable law or imposes an unreasonable burden on the Website.
Applicable Law and Jurisdiction
This Website, its contents and the relationship between the ASPC and its users shall be governed by Spanish law, without prejudice to any mandatory provisions that may apply under European Union law or the law otherwise applicable to a particular user.
The ASPC is a non-profit association constituted and registered in Spain under Organic Law 1/2002 of 22 March, regulating the Right of Association, together with any other applicable Spanish legislation and its own By-Laws.
For matters concerning the interpretation and application of the ASPC’s By-Laws, the dispute-resolution provisions established therein shall apply. In particular, the By-Laws provide that disputes relating to the interpretation and application of the By-Laws that are not mandatorily subject to determination by a judicial or administrative body shall be submitted to the Court of Arbitration for Sport (CAS).
Nothing in this clause shall be understood as depriving consumers or other users of any mandatory rights or jurisdictional protections that cannot legally be waived under applicable law.
Any matters not expressly governed by this Legal Notice shall be governed by the applicable provisions of Spanish and European Union law.
